Agreement to Arbitrate
By using hpdiscounts.com (the “Site”) or purchasing any products or services from HP Discounts (“Company,” “we,” “us”), you agree that any dispute, claim, or controversy arising out of or relating to your use of the Site or these Terms (collectively, “Disputes”) will be resolved exclusively through binding individual arbitration, rather than in court, except as described below.
No Class Actions
You agree that any Dispute will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to:
Participate in a class action lawsuit
Act as a class representative
Join or consolidate claims with others
The arbitrator shall have no authority to hear or arbitrate any class or collective action.
Arbitration Procedures
Arbitration will be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules. The arbitration will take place in a mutually agreed location or, if not agreed, in the county where you reside or via remote proceedings.
Exceptions
Nothing in this section prevents either party from:
Bringing claims in small claims court (if eligible)
Seeking injunctive or equitable relief for intellectual property or unauthorized use
Opt-Out Right
You have the right to opt out of this arbitration agreement and class action waiver. To do so, you must send written notice to:
HP Discounts
support@hpdiscounts.com
within 15 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
Severability
If any part of this section is found unenforceable, the remaining portions will still apply, except that if the class action waiver is found unenforceable, then this entire arbitration section shall be null and void.
